THIS Sunday, if Allah Almighty wills, some 80,000 people will take part in a large conference here, whose main aim is to disseminate the call for the revival of the khilafah (caliphate). To be held at the Gelora Bung Karno Sports Stadium, the gathering will feature both domestic and international speakers of Hizbut Tahrir movement as well as leaders of other Islamic organisations.


Hizbut Tahrir, as introduced in its Britain's official Internet site, is a global Islamic political party that was established in 1953 under the leadership of its founder _ the scholar, political thinker and judge in the Court of Appeals in al-Quds (Jerusalem), Taqiyuddin an-Nabhani. Hizbut Tahrir global leadership is currently headed by Ata' abu Rishta.

 

Hizbut Tahrir works at all levels of society to bring Muslims back to living an Islamic way of life "under the shade of the Khilafah State following an exclusively political method". The movement claims to adopt the methodology employed by the Prophet Muhammad (peace and blessing be upon him) when he established the first "Islamic State" in Madinah.

 

In Hizbut Tahrir's point of view, the Prophet limited his struggle for the establishment of the Islamic State to intellectual and political work. Instead of resorting to violence, the Prophet mobilised public opinion in favour of Islam and endeavoured to sway the political and intellectual elites of the time.

 

For us in Brunei Darussalam, the system is not a strange thing. In fact, it could very well be considered personal because HRH Al-Muhtadee Billah, our own Crown Prince, bears the same name as that of the 13th Caliph (868 AD) in the Khilafah Abbasiyah (Abbasid Chaliphate) known for its scientific and technological achievements.

 

Even if, as history shows, the Khilafah Abbasiyyah recorded many differences from the system adopted by Khulafaur Rashidin (the four Rightly-Guided successors of the Prophet: Abu Bakr As-Siddiq, 'Umar ibn Khattab, 'Uthman ibn 'Affan and 'Ali ibn Abu Talib), it was legally and scientifically considered as the ideal form of Islamic political leadership after the Prophet era.

 

Relations between Brunei Darussalam and the caliphate go beyond similarity in names _ the sultans of Brunei made a conscious effort to sustain those ties with the Uthmaniyyah Caliphate in Istanbul. Khilafah Uthmaniyyah ended on March 3, 1924 with the establishment of the secular Republic of Turkey under the leadership of Mustafa Kemal.

 

In the "modern" discourse, a Khilafah (which seeks justice as part of the worship and obedience toward Allah, in the spirit of loving Rasulullah, be it spiritually, through the search for knowledge, through the building of a just community) is often considered an Islamic anti-thesis toward a Western globalised system that is capitalistic, materialistic and secular.

 

However, as a form of ijtihad (the reform in implementing religious life), the line and direction taken by Hizbut Tahrir is not free from criticism.

 

In Indonesia, Hasyim Muzadi, chairman of Nahdlatul Ulama (the largest organisation of so-called traditional Muslims), called Hizbut Tahrir "a transnational ideological movement which threatens Indonesia's national unity". He said, "We must be wary of movements that do not spring from Indonesian traditions."

 

Hasyim's fears are understandable given how Indonesia has yet to recover from the various social, political and economic upheavals of recent decades, as well as the numerous natural disasters.

 

If it is true that Hizbut Tahrir seeks to replace the secular nationalism adopted by Indonesia at its proclamation of independence 62 years ago, then it certainly must be described as a threat for Indonesia.

 

At the international level, eminent jurist Yusuf Qaradhawi has also criticised Hizbut Tahrir for turning its founder Sheikh Taqiyuddin An-Nabhani into a cult. "They accept whatever Syaikh Taqiyuddin has to say about the economic and political system as if it was the religion of Allah rather than a personal ijtihad that can sometimes be correct but can also be mistaken at other times," Qaradhawi has said.

 

There are other criticisms such as one that sees Hizbut Tahrir as a partial movement emphasising politics while ignoring that Islam is a complete way of life that touches all aspects such as economics, social and culture, defence and others. This is in line with the movement's own declaration through its official site (www.hizb-ut-tahrir.org), "Hizb ut-Tahrir is a political group and not a priestly one. Nor is it an academic, educational or a charity group."

 

Will the conference on the khilafah be able to respond to the increasing list of criticism? Let us wait and see how the conference evolves in Jakarta, while praying to God Almighty that the growing organisation will add only good to mankind.

Abu Idrees: Ijtihad
In response to the critisms by Yusuf Al Qaradawi, if the article is assumed to be true:

The Scholar mentioned: knows that Ijtihad is the process by which a divine law is extracted from the sources of Islamic law and not merely a personal opinion, for it would be personal if the Islamic evidence was ignored but rather it is, the opinion of the scholar as he understands the divine text based on the method of ijtihad, all of which is underminned by evidence contained/ indicated within the sources of law, therefore it can not be described as personal as if one was to say: this thing is personal to me, for the divine law does not leave the human being to decide but rather gives him guidance as Allah (swt) mentioned to pharaphrase: "We revealed the book (Quran) explaining all matters", some of these matters are clear, as for those that require ijtihad, Islam defined a methodology that removes personal whims and desires.

Therefore if any scholar undertakes an ijtihad and its evidences are studied and questioned and found to be true, then it is not a question of taking a man as a cult figure/ religious figure etc. it is rather the appreciation of his knowledge and the soundness of his extraction and its correctness or closeness to what is required from the human being, is soundness established be debating the evidence and not because of a personality, Name or the numerous number that may hold or reject a particular opinion. In this respect Hizb-Ut-Tahrir is no different in their approach and their open talks and ample oppurtunity form question and answers reflects the openeness of their approach, unlike some meetings we witness where the oppurtunity to openenly/ freely quetion is shunned and explained away by saying: you are not a scholar or how can you question a scholar or on phone-in show, the line is cut off, this is no problem when somehting is irrelevant but when it is the norm then there is a problem in my opinion.

ibn khadija tul kubra (sa): correcting the corruption? who's job?
Imam Al Gazzali (rh) beautifully stated, "the corruption of the people is due to the corruption of the rulers,the corruption of the rulers is due to the corruption of the scholars, the corruption of the scholars is due to love of life and hating death"

The prince of believers, Umar bin al Khattab warned the ummah that Islam will be destroyed by two types of people, "the hypocrite writing about the quran and the false fatawa's of the scholars".

Imam ahmed in his Musnad narrated a number of ahadith that stated that the prophet (saw) warned the muslims that the fitnah of the corrupt scholars if by far worse than the fitnah which will be caused by ad-dajjal.

But enjoining the maroof and forbidding the munkar is a responsibility of every sane muslim but more so with those who have knowledge, and we must account the scholars for dollars with frankness and remind them that they should seek to have the piety of abu bakr (ra), the courage and frankness of Umar (as) the the hiyaah of usthman, the bravery of Ali (ra) and seek mawt the way of Imam Hussain (ra)
Allah (swt) says in surah anaam, "and if you obey them verily you are of the mushrikeen"

Imam AI-Ghazali in Ihya'a Uloom id-Deen, volume 7, page 72 said, "This was the way and tradition of the scholars: commanding good and forbidding evil. They cared less for the might of the rulers. They depended on Allah's blessing to protect them and accepted Allah's rule of giving them the Shahadah. When their intentions were pure, their words softened the hard hearts. But now, greed has tied up the scholars tongues and made them quiet. Even if they talk, their speech will help none of the affairs at hand and thus they will fail. Had they told the truth and intended to give knowledge its due right, they would have succeeded. The corruption of the people is due to the corruption of the rulers; the corrupt rulers exist due to the corruption of the scholars (for the scholars are not speaking out against these rulers); and the corruption of the scholars is due to the love of wealth and power.

Whoever is dominated by the love of this world, he is so preoccupied that he is unable to question the general public. If he cannot even question the general public of their duty, then how will he have the capacity and the courage to question the rulers and those in higher positions?"

surely the scholars are the ones who should be leading from the front the call for the re-establisment of the khilafah may be some scolars today dont want to go from luxury to ruin meaning the have ruined their hereafter and taken care of life hence they fear death at the ends of the masters who feed them and pay them to rubber stamp their fitna on the dunya

Imam Malik bin Anas stated: "It is a duty upon every Muslim whom Allah has given some knowledge or fiqh to confront any ruler, command him to do good, forbid him from evil. This differentiates the scholar from others when they approach a ruler. This is the status that is not surpassed."
