Shouting "Allah is great", and waving black and white flags, about 80,000 members of the radical Islamist group Hizb ut-Tahrir gathered in a sports stadium in Jakarta yesterday to call for the creation of a Muslim state spanning the Islamic world.

Hizb ut-Tahrir, which is banned in several countries, including France, Germany and the Netherlands, has a strong following in Indonesia, the world's most populous Muslim state. Delegates at the Bung Karno Stadium had also come from Europe, Africa and the Middle East.

Two speakers - Imran Waheed from Britain, and Ismail Al Wahwah from Australia - were refused entry into Indonesia. The decision by immigration authorities was denounced by Ismail Yusanto, a spokesman for the group's Indonesian branch. "Those responsible for this are being paranoid," he said. "This has hurt our freedom of expression."

Britain has considered outlawing Hizb ut-Tahrir, which was founded in Jerusalem in 1953. But Tony Blair, decided against it, after being advised by police that a ban would merely force it underground.

Critics say that its ideology is close to that of violent jihadist groups, and that it radicalises young Muslims who then choose a path of violence. Hizb ut-Tahrir insists that it opposes violence, and it has denounced terrorist bombings in London, Madrid and Bali. It has a strong presence on university campuses in Britain, some of which have banned it.

The radical Indonesian Muslim cleric, Abu Bakar Bashir, was scheduled to address the biannual international rally. But organisers asked him to withdraw, after police raised security concerns. Mr Bashir served two years in Jakarta's Cipinang jail after being convicted of involvement in the 2002 Bali bombings. The conviction was later overturned by the Supreme Court.

Another hardline Indonesian cleric, Habieb Rizieq, was also advised by police not to attend.

Many of Hizb ut-Tahrir's supporters arrived in convoys of buses from other regions of Java, Indonesia's main island, and neighbouring Sumatra island. Amid music and prayer, speakers called for a renewed commitment to revive the Caliphate - a single state across the Muslim world - through peaceful means.

Mr Yusanto said: "After the destruction of the Caliphate, tragedy after tragedy has descended on the Muslim world. Our nation has been divided into 50, and the infidel colonialists picked rulers in each."

Salim Frederick, of the group's English branch, said: "We need to carry this message from every corner from the east to west, so that on judgement day we can be proud." Erni Tri, a 40-year-old teacher who had driven for two hours with her husband and three children to attend the rally, said that she liked the group because it was "firm and uncompromising towards un-Islamic cultures". She said: "It is driven by love for Allah and has no hidden agenda to get votes or power."

Although the group's gatherings are usually peaceful, the United States embassy in Jakarta had warned its citizens to avoid going near the stadium.

Abdullar Gymnastiar, a popular and moderate Indonesian preacher, said it "hurts our feelings" to be labelled as radical. "We don't tolerate at all to engage in violence, especially terrorist action," he said. Abdul Wahid, chairman of Hizb ut-Tahrir in Britain, condemned the deportation of Dr Waheed. He said in a statement yesterday: "Hizb ut-Tahrir has spearheaded a crucial debate on the future for the Muslim world - an alternative to corruption and dictatorship.

"We hear endless rhetoric about a battle of ideas, but the only action we see are bans, smears and an attempt to silence debate."

Is knowledge Quran and Sunnah and wisdom (implementation of knowledge in right place at the right time) the only requirements to be a Khalifah, leader or Imaam? Allah says in 2:247 that He chose Talut to rule over people and blessed him with ilmi wal jismi. This makes knowledge and stature (physical strength, bodily physique) to of the most fundamental requirements for these positions. Studying the life of the companions, radi Allahu anhum, it is explicit that that all of them, whether slaves (Zaid bin Haris, Bilal bin Rabaah or Nafey radi Allahu ahum) or sons of slaves (Abdullah bin Zaid) or Bedouin foster mothers (Umm Aiman) were highly literate of Deen, luminaries in the field of Islamic education and practice. Is it any wonder that Rasool Allah sallahu alyihi wa sallam said that his era is the golden era of Islam.
When I said the new Khalifah will be from the scholars of our time, I was actually encouraging myself and the Muslims to obtain as much knowledge as they are able. Free up their schedule and take out time to study, contemplate and research. Acquire knowledge, if not out of admiration of the companions radi Allahu anhu and in the spirit of imitating them, if not for the re-establishment of the Khalifah system, then at least for the sake of our Salvation. Abu Hurirah radi Allahu anhu reported, Rasool Allah sallahu alyihi wa sallam said, “Whoever treads the path in search of knowledge, Allah makes his way to Jannah easier” (Muslim). Anas radi Allahu reported that Rasool Allah sallahu alyihi wa sallam said, “He who goes forth in seeking knowledge is in the way of Allah until he returns (Tirmidhi). Where and how much have we (addressing the general 1.6 billion+ Muslim population, including myself) traveled in search of authentic Islam knowledge? Imaam Bukhari traveled for 16 years and had over a thousand Shuyuk (teachers). How many teachers have we learned Deen from? Abu Hurirah radi Allahu anhu narrated 5,374 ahaditih. How many can we recall with the proper chain or narrators? Aisha radi Allah anha, at the age of 18, had 2,210 ahadith memorized. How many chapters of the Quran, how many Juzz have do we know by heart? I feel ashamed akhi, we make big claims, but our knowledge and efforts are small. May Allah forgive us our sins, increase us in beneficial knowledge and acceptable deeds and grant us pure provision (aameen). Assalam alikum warahmatullah.

Assalam alikum warahmatullahi warbakatuhu akhi. Foremost, I yearn for the re-establishment of the Khalifah system as much as you. So allhumdulilah we are both on the same side. May Allah accept our humble efforts in this cause, aameen. Secondly, in regards to the selection of a Khalifah, after the death of Rasool Allah sallahu alyihi wa sallam, Abu Bakr radi Allahu anhu nominated Umar bin Al Khattab and Abu Ubaidah bin Al Jarrah as the next Khalifah. Umar radi Allahu anhu because Rasool Allah sallahu alyihi wa sallam gave him the title of Al Farooq (the one distinguishing between right and wrong). When he accepted Islam, 8:64 was revealed. About him, Rasool Allah sallahu alyihi wa sallam said, “By Allah, Satan will never tread the way you pass through” and another occasion he said, “Had there been a prophet after me, he would have been Umar”. Rasool Allah sallahu alyihi wa sallam, when speaking of Umar radi Allahu anhu also said, “Umar is the lamp of heavenly people”. Abu Ubaidah was nominated because Rasool Allah sallahu alyihi wa sallam called him, The Trustworthy of the Nation. When the leaders of Najran came to Rasool Allah sallahu alyihi wa sallam with the intention of doing Li’an, but later got scared and backed out saying, “we’ll give what you have asked for, but you should send a trustworthy man to us”. Rasool Allah sallahu alyihi wa sallam agreed and all Ashaab radi Allahu anhum desired to win the title of “Trustworthy”, including Umar radi Allahu anhu. Umar even says, “I never liked authority except on that day when I hoped to be the one worthy of that title”. Nevertheless, Rasool Allah sallahu alyihi wa sallam selected Abu Ubaidah saying, “Go with them, and judge between them with justice”. These words of praise, excellence and honourary titles are proofs that Umar and Abu Ubaidah radi Allahu anhum were scholarly companions. Recognized by Rasool Allah sallahu alyihi wa sallam as being prestigious, righteous and noble due to their education. Only a tremendously knowledgeable and wise person can be titled Al Farooq or made judge over people. However, Abu Bakr radi Allahu anhu was chosen to be the first Khalifah because he proved to be a greater scholar than both Umar and Abu Ubaidah. Regarding Abu Bakr, Umar said, “Abu Bakr is the most excellent among the Muhajirin. He has been the Companion of the Prophet sallahu alyihi wa sallam in the cave; the Prophet sallahu alyihi wa sallam asked him to officiate in leading the Muslims in prayers, and the prayer is the most superior of all other Articles of Faith. Therefore, none is entitled to assume the duties of the Khalifah in the presence of Abu Bakr”. After this speech, Umar radi Allahu anhu stretched his hand to give bai’ah to Abu Bakr radi Allahu anhu. Then Abu Ubaidah, Bashir bin Sa’d Ansari radi Allahu anhum ajma’een followed in this order.

SubhanAllah, examine the selection of an Imaam (Among all companions Abu Bakr Siddiq was made imam in masjid nabwi in the presence of Rasool Allah sallahu alyihi wa sallam). What is the criteria for this job? It is recorded in Saheeh Al Muslim that Rasool Allah sallahu alyihi wa sallam says, “The Imaam of the people should be he who knows the Quran the most (i.e. translation, tafseer, expert in recitation etc). If people are equal in their knowledge of the Quran then Imaam should be he who is most aware (and practicing) of the traditions (sunnah) of Prophet Muhammad sallahu alyihi wa sallam (ya’ni the person who knows the ahkam and the solutions). If the people are equal in their knowledge of the sunnah then Imaam should be he who immigrated to Medina first. If the people immigrated together, then Imaam should be he who is the oldest in age…” It is recorded in Al Bukhari that Umar bin Salamah said that his knowledge of the Quran was more than any of his tribesmen thus they elected him as Imaam. Conclusively, a person has to be at least scholar (of Quran and ahadith) among his people to qualify as Imaam or Khalifah. Before Abu Bakr radi Allahu anhu passed away, he consulted with Uthman, Ali and Talhah radi Allahu anhum about appointing Umar as the next Khalifah. Abu Bakr announced, “I would like to appoint Umar as the Khalifah of Muslims”. Talha radi Allahu anhu asked, “What answer will you give to Allah about what you have done to the people you ruled over?” Abu Bakr radi Allahu anhu replied, “I will answer Allah that I have appointed the best of Your creatures (Umar) as Khalifah for Your creatures”. What enabled Umar radi Allahu anhu to be titled “the best” of Allah creatures? Rasool Allah sallahu alyihi wa sallam said, “The best among you are those who study and teach the Quran” (Al Bukhari). Not only was Umar radi Allahu anhu a scholar of the Quran, but also among the scholars of ahadith (he narrated 539 ahadith).

Khilafah is a fard on the Muslim Ummah. It is not a condition for the one who calls to the good that he/she be a scholar. It is only a condition that he knows about the issue in question. So I do not need to be a scholar to tell my kids they must pray or fast or to advise someone. Establishment of a state requires all components of society to work collectively. The Scholars have a vital role BUT the rest of us must do what we can.

The headline says, the Islamists are demanding a Muslim State. Whom are we “demanding” it from? Who is going to give us a Khalifah? What the author (Kathy Marks – presumably a non-Muslim) and many Muslims do not understand is that like the Khalifah conference, it is we by the immense Grace of Allah subhana wat3ala, you and I who are going to bring about the Khalifah system.
Now as a matter of general principle, the successor of a Prophet must be a Prophet. However, since a teacher-Prophet departs (like Isa alyihi sallam) from the world only after completing the task assigned to him, he needs no successor. However, as far a monarch-Prophet (i.e. Dawood alyihi sallam, Rasool Allah sallahu alyihi wa sallam) is concerned, nobody can succeed him as a Prophet but his rule may be succeeded by anybody as a successor. Since the successor would have been brought up under the shadow of the Prophet’s teachings, he is supposed to be the most suitable person to do the job. So who among us would be the most suitable person for the job? Who can be the next successor to Rasool Allah sallahu alyihi wa sallam?

Answer: Abud Darda radi Allahu anhu reported, Prophet Muhammad sallahu alyihi wa sallam said, “He who follows a path in quest of knowledge, Allah will make the path of Jannah easy for him, and indeed, the angels lower their wings for the seeker of knowledge, being pleased with what he does. And indeed, the inhabitants of the heavens and the earth and even the fish in the depth of the waters seek forgiveness for him. The superiority of the learned man over the devout worshipper is like that of a full moon to the rest of the stars (i.e. brightness). The learned are the heirs of the Prophets who bequeath neither dinar nor dirham but only knowledge; and he who acquires it, has in fact acquired an abundant portion” (Abu Dawud & At-Tirmidhi). Therefore, the next Khalifah will have to be from the Scholars. And unless we devout ourselves to study, acquire authentic and extensive (Islamic) knowledge and convert our homes to centers of Islamic education, we will not be able to breed a generation of genuine Muslim Scholars, possible candidates to be the next Khalifah. So please, don't demand on streekts. Seek in books and in the company of scholars.

Freedom operations within the limits of the law. For a lawyer, freedom of expression means ‘the absence of restraints upon the ability of individuals or groups to communicate their ideas to others, subject to the understanding that they do not in turn coerce others into paying attention or that they do not invade other rights essential to the dignity of the individual’. Freedom of expression includes freedom of the press and the liberty to communicate ideas in all forms including books, pictures, signs and other means of communication. The purpose may be to inform, to persuade, to convince others, to reveal the truth or to clarify and eliminate doubt. Many national and international documents which declare human rights acknowledge the fact that freedom of thought and freedom of expression are intertwined. The Universal Declaration of Human Rights which was issued by the General Assembly of the United Nations in December 1948 affirms these freedoms as basic human rights (Article 18, 19). Interestingly, freedom of thought and belief is repeatedly emphasized in the Quran. See, 2:256, 10:99, 11:28, 88:21-22.
In all honesty, Islam grants human beings total intellectual freedom. Rather it would be truer to say that it was Islam which for the first time in human history brought about a revolution in freedom of thought. In all the ages of history prior to Islam, the system of despotism prevailed, and human beings were consequently denied freedom of thought. This was a matter of the utmost gravity for it is a fact that the secret of all human progress lies hidden in such freedom.

Human beings are thinking creatures. Of necessity we form opinions. If curbs are placed on the independent expression of our views, the content of our thought may remain unchanged, but our ideas will never find expression in his speech and writings. Curbs, imposed by a community, will ultimately produce a society of state controlled mobsters and gang members where the public says and does what it is being told without having to think about it. No intellectual person would ever wish to live in such a repressive atmosphere. It is only freedom of thought and expression which can save humankind from robots. Moreover, intellectual freedom is directly related to creativity. A society with freedom of thought will produce creative human beings: a society which places curbs on freedom of expression will necessarily witness intellectual stagnation; it will stop producing creative minds, and its development will come to a final standstill. Much like the state of the Muslim Ummah today. Condoning freedom of thought and expression has closed doors for ijtihad which has ultimately caused the demise of Muslim Unity. Since Muslims are not welcomed to share their opinions, they have gone off making their own groups and have divided themselves into sects.

Brother abu Abdullah and all my brothers and sisters out there, we don’t know our own Deen enough to have the luxury to label anyone a believer or disbeliever. Rasool Allah sallahu alyihi wa sallam said, “He who believes in Allah and the Last Day should speak good (also see 2:83) or remain silent” (narrated by Abu Hurairah radi Allahu anhu, recorded in Al Bukhari and Muslim). Sects exist because authentic (Islamic) knowledge is not circulated among the Muslim commoners, the everyday people. It sits on shelves collecting dust, and sadly too many people are hypnotized by the TV or the internet to go out and do genuine research or sit in the company of scholars. The Mullahs and the Molvis falsely decide what is Haqq and Batil while masses follow their ruling like cattle and sheep. Creation of a Khalifah state demands tolerance for freedom of expression and thought, along with a culture which celebrates the circulation authentic (Islamic) knowledge, which invests in the (Islamic) education and welfare of Muslims, everywhere. Much like Darul Arqam (prior to Hijri), Masjid Nawbi sallahu alyihi wa sallam (post Hijri) and Al Huda Institute (21st century - http://www.alhudapk.com/).

brothers freedom of expression is kufr fear Allah

Editor's note: Dear brother it is against Islam that one accuses someone of Kufr so easily. We know that the media will often misquote or place quotes without its context. Without first enquiring as to what was said, the context etc... such a response harms the unity of this ummah and does nothing to build trust between brothers. Please brother take this as advice.
