Hizb ut-Tahrir calls for debate on Secularism and Shariah Print E-mail
Press Release
Friday, 08 February 2008
London, UK, February 8 2008 - Despite the Archbishop of Canterbury's request for a sensible debate on the matter of Shariah in civil law, the response in the media can only be described as a fanatical and emotional outpouring of exaggeration, misrepresentative statements, untruths and sometimes vitriolic hatred.

Hizb ut-Tahrir Britain will be writing to politicians, journalists, academics and opinion formers over the coming week proposing an open, sensible and rational debate about secularism and the Islamic Shariah, in the context of problems in today's world.

Commenting on this, Taji Mustafa, media representative of Hizb ut-Tahrir Britain, said, "The response to Dr William's comments illustrate both the profound level of ignorance in Britain about the Islamic Shariah and the near total blindness of some to the flaws within secularism and the harms it has caused in its implementation across the world. Xenophobia, the inherent assumption of superiority, and poor treatment of minorities is sadly part of Europe's tradition. Tolerance and pluralism are hollow slogans alongside this barrage of abuse, characterising the limited ability of this secular society to accomodate difference. By contrast, the rights of minorities were protected in the Islamic tradition. The Shariah law protected the right of citizens of other minorities to live according to their faith traditions within their personal lives. Though many in the west claim to approach issues rationally, many utterly fail to respect the opinions of those they disagree with."

"Although the context of Hizb ut-Tahrir's work is, and always has been, to work for an Islamic state in the Muslim world, the debate thus far has neglected the fact that it is not Muslims campaigning for Shariah in Britain that is a cause of tension. It is the policies of western governments to deny people's desire to live by Shariah in the Muslim world. Indeed, it is the height of hypocrisy that politicians and media who approved the bloodshed in Iraq and Afghanistan to export a secular system to the Muslim world, cry about protecting Britain's traditions and heritage, whilst obstructing the desire in the Muslim world to have laws that reflect their Islamic beliefs, heritage and system. For Muslims the world over, the Islamic Shariah is what brought civilisation and learning that characterised a golden age, such as that in Muslim Spain; it is the Shariah that guarantees an end to dictatorship, oppression and torture; it is the Shariah that protects family values in society; it is the Shariah that works to redistribute wealth and end poverty; it is the Shariah that restores the honour and dignity of women, allowing them to participate in society as human beings and not as commodities; it is the Shariah that protects people's privacy; it was the Shariah that allowed Muslim, Jew and Christian to live side by side for centuries in relative harmony; it was the Shariah that brought justice and stability to what are now some of the world's most trouble regions."

"By contrast, when Muslims the world over look at secularism, liberal democracy and the capitalist free market they see enormous problems that some in the west simply fail to acknowledge. They see the century that secularism dominated was the arguably the bloodiest in human history, causing instabilty and conflict across the world; they see record gaps between rich and poor within and between states; they see the breakdown of family life and record numbers of broken families; they see a rampant individualism and consumerism; they see people increasingly disinterested in their own political process; they see rising social problems of drugs and alcohol abuse; they see an increasingly intrusive state and a surveillance society; they see an inability to bring about societal cohesion and to tolerate difference in society; they see an aggressive and militaristic foreign policy for material resources and political dominance. These are only a few things that have contributed to the failure of secularism to gain a foothold across the Muslim world. These are all very much in need of debate and discussion."

"It is our intention to open such a debate. We hope others will join us in it. However, we expect many will run away from such an honest appraisal of both systems, prefering abuse and generalisation to debate and discussion."

Poet786: Shariah Law is inevitable...
Shariah Law is inevitable in the Muslim Lands, it is the promise of Allah (swt), the prophecies of Muhammad(saw) and the desire of the Muslim masses. However, Muslims in Britain are not demanding it here as this goes against Islam which teaches that the whole system needs to be Islamic not just some aspects and we need to remember that you cannot have Shariah Law unless it's implemented by a legitimate Islamic Government- the Caliphate.

muhamad abdullah: Secular vs Shariah
Secular law in the EU: A killer found guilty in the courts of law after due judicial process will be sentenced to imprisonment for life.

Secular law in some states of the USA: A killer found guilty in the courts of law after due judicial process will be sentenced to death.

Secular law in China: A killer found guilty in the courts of law after due judicial process will be sentenced to death.

Shariah law at any place on earth: A killer found guilty in the courts of law after due judicial process will be sentenced to death, unless the victim's family offer pardon with or without demanding 'blood' money.

Secular laws can't even be equal/just to an American convicted of crime done in an EU land and the same American if he committed the crime in the land of the USA.

Such 'progressive' and "civilized" laws can't even put equal 'values' to the soul and blood of a victim.

This is just one minute aspect of the law and code of conduct in life. How about the laws on gas and petrol, about copyrights (hallelujah to all Open-Source advocates!!), about spying on personal homes, about crippling debts based on usury, all of which affect our daily life to the point that we work our as*** off just to survive in this modern-day slavery to the powerful and rich, on all of which Shariah has a fair and just view.

Yet what you see and hear are all these ignorants calling Shariah barbaric, medieval and synonimous to beheadings!

It is 'wajib/fardh' on us to interact with these ignorants and tell Islam as it is. It is 'wajib/fardh' on us to tell these ignorants to stop interfering in the affairs in Muslim land.

One final mind exercise: a killer committing the crime on a naval ship in international waters off the coast of Alaska. What will be the sentence in secular and Shariah laws?

No wonder hundreds of millions of Muslims in the Muslim land are demanding their medieval laws back!

Had the comments been about Jews incorporating parts of the Talmud would the media have reacted in this hysterical way? Would there have been images of killing the goyim?

Usman: Response to John
“Go back to your own country”, this is hardly an intellectual response, rather defeatist I would say, no one is proposing that shariah law be implemented in Britain, please understand the context of the debate before you get all emotional. Secular democracy does a superb job all on its own in demonstrating that it is barbaric, take for example the one million civilian deaths in Iraq alone as a result of a colonial foreign policy, not to mention all the other wars which secular democracies have waged against other nations for the purpose of seeking colonial interests to which history does testify.

The reason democracies are having such a difficult time in the world is because its these very values which are being undermined, take for example the presumption of innocence…. Charles demenenzes is a perfect example, Abu Garaib prison, Guantanamo Bay, and the list goes on and on. The support of dictators and tyrants in the world who are well know for their human rights violations, all of the above and more indicate clearly that democracies have no moral legitimacy to parade these values as superior and universal.

The point at issue is this. The Muslims have their own way of doing things, the failures of secular doctrine imposed on Muslim lands is self evident. The public opinion in the Muslim world is change, the people in the Muslim world have a right to decide their own political destiny and should not have imposed on them that which they don’t believe in just like you don’t want shariah applied in Britain, they don’t want democracy, it is really that simple. The Muslims should decide what system they want without the interference of others.

H Khan: The land of the hypocrites... for the whole world to see.
"...Prime Minister Gordon Brown entered the 'debate' saying that laws in Britain should only be based on British values - although where lucrative profits for the City of London are concerned, he is happy to promote Britain as a centre for 'Shariah' compliant finance!!!"

Democracy - such is Hypocracy.

Irfan Bhatti: FAO John... Islam in the Muslim Countries
FAO John. I think you misunderstand. As far as I am aware, Hizb ut Tahrir is calling for the Islamic System of Khilafah to be implemented in the Islamic countries, not in Britain. They have specifically stated this point.

It is the British Prime Minister and American President who have openly said they will not tolerate the Islamic Khilafah System in the Islamic lands. So no matter where any Muslims go, British and American governments will always interfere in order to ensure Muslims don't live by THEIR values in THEIR own lands.

Also, the reason why the Muslims are so upset about the media reaction to the Archbishop of Canterbury's statement is because of the unbelievable hypocrisy of the British government. The politicians have insisted that their is no room for a legal framework or any set of laws to be implemented if it is not based on the British values. Then at the same time, they interfere comprehensively in the Muslim lands to ensure that the Muslims do not implement a legal system that is inline with their values and belief. Instead they are forcing their secular values and Democratic system through the barrel of a gun. When you look at the example of Iraq, if the problem was Saddam then why work to remove the system as well as the ruler?

I hope you can appreciate the hypocrisy of the government and the frustration of the Muslims who want to implement Islam in THEIR OWN countries.

saleem: Excuse for bigots
Refardless of the intentions of the Archbishop of Canterbury, the reaction of the media has shown the utter hatred of all things Islamic by many of the non-muslims. Calling for a debate is one thing but I doubt the offer will be taken up. Had the Archbishop spoken of Jews and parts of the Talmud to be implemented the media would not have gone into a frenzy with quotes about killing the goyim.

Zain: Lets Debate! - Finally!
Well said Hizb!

This is the confidence that we as Muslims have in the Sharia!

An Open debate is what is much needed to this society and asnwer some of the questions and misconceptions that the non muslims and Muslims alike have about the Sharia.

Many when they hear about the Sharia they only know about one aspect which is the sentences, but the same people who will know about these sentences when asked about other aspects of the Sharis they won't know anything, yet they feel that they have the right to decide and demonise a Law that they have not event looked at or studied?

Sharia law in the media has been portrayed unfairly and most people only know what they have been fed.

If this is the basis from which someone or a society choses what laws we should have then I call for Democracy to be abolished....after all it is Barbaric...the "Free " world also sentences to death, Decapitation, stoned to death or death by leathal injections...they all lead to one...and that is Death.

Makes you think about Democracy and Secularism.....doesn't it?..

So let's debate, It is a much overdue debate if you ask me and as the comment above says, enought with the appologetic stance and lets speak the Truth as we as muslims have been instructed by Allah SWT.

Peace to all.

Abdullah ibn Adam: Let Muslims debate it
To say that the response from some politicians and media outlets were “provocative” is rather polite and an understatement! It is clear to anyone who read the Friday papers with an open mind that the vitriolic, ignorant, and many falsified anti-Islamic propaganda comments and reports were sickening. Every comment came with a supremacist undertone. The rightwing fanatical papers went out of their way to propagate their (now customary) hatred against Islamic Shariah law.

These secular fascists are hatefully preaching to us what they don’t practice themselves, i.e. governing Britain by British values. Yet they are committing mass scale bloodshed in the Muslim world to prevent Muslims from ruling by their values.

This is clear evidence, if it was ever needed, that the secular fascists have lost all intellectual arguments to diminish the importance of Islam and Shariah in the minds of the Muslims and are now resorting to desperate ugly propaganda to spread unsubstantiated lies against Islam.

Muslims must welcome this discussion with an open arm. Let us not bend over backward to apologise for the Shariah. If the west could be proud of its greedy and bloodthirsty colonial past, Muslims have an added reason to be proud of their Golden Age that was in fact due to the Shariah – not in spite of it.

I welcome HTB’s debate and look forward to see what comes out of it. But I suspect this will not be welcomed by the enemies of Islam.

As for poor Dr Williams, he must have realised how dreadful a mistake he made when he upset the secular fascists – never to be repeated again!

Zafar Basar: Secularism are no solution to life problems
As the call for the Khilafah and the return to Ahkam Syariah gains momentum in muslim lands, it is not surprising that the eminent Arch Bishop has called for the application of Syariah Laws in the UK. The secular society has to realize that secular systems does not offer solutions to life problems in society, but only increase those problems. The British government will never allow this, because of the fear that Syariah Law, when applied will threaten the existence or replace the secular laws in Britain. As evident in history from the opening of lands in Persia and North Africa from military campaigns by the Khilafah, the application of Syariah Laws has brought the people to the fold of Islam, as it is solutions to life problems.

Owais: Delusion of Secularism
That was only a right thing to do if the west is so confident about the supremacy of its ideology. the challenge is spot-on.
But it will be naiive to think that the west would engage in such an open debate, while it has failed in convincing the world even through coercion, its bombs and its chilling propaganda. The west got used now to making such supremacist comments to the air -about its way of life, since they are sure that their embedded media will somehow do not allow the other voices.
I think it is in the interest of the west to engage now, rather than wait until the debate will appear on a state to state level. It does not need a Nostradamus to predict the outcome. Let's see.

Abdul-karim: Unified against The Shariah and Islam
"The prime minister is clear that in Britain, British laws based on British values will apply," a spokesman for Prime Minister Gordon Brown said. All political parties have come out clearly and in a unified manner in revealing their hatred towards the existence of any form of shariah in the UK. Even they define the shariah as the : body of Islamic religious law based on the Koran, the words and actions of the Prophet Mohammad and his companions, and rulings of Islamic scholars. Hence when they attack the shariah they no exactly what they are attacking i.e. the teachings of the Quran al-Kareem and Sunnah ash -Shareef. As such they are making very clear their belief that the values and laws of Islam (the shariah) are not compatible with their laws/values etc.. From their stance it can be understood that integration means for them that we abandon what Allah (swt) has commanded and replace it with their way of life, nothing else would be acceptable. It should also be very clear to any muslim who likes to say or believe that Islam and the western way of life are compatible, that the westerners in no way believe it. They have given us a clear choice British based on british laws and values or Muslim following the laws and values revealed by Allah (swt). Alhamdulillah ! I know what my decision is.

Usman: Secular democracy on the retreat!
The era of appologists has come to an end, Islam is the truth and we do not appologise for any part of our deen, the momentum for the re-establishment of khilafah in the muslim world is rapidly increasing day by day, and what better a platform for such a debate, in the heart of secularism.I for one welcome this debate, Allah Huakbr! It will be interesting to see what the respose to this challenge will be, personally i dont think they will engage, with such a weak and decadant ideology i dont blame them.
